By registering, accessing or using the platform of Nestermind AG, Schaffhauserstrasse 78, 8057 Zurich ("Nestermind") agree to these terms and conditions ("Terms and conditions").
These conditions apply to all users, including individuals, real estate agents, intermediaries and other professionals in the real estate sector ("Customers").
Nestermind AG offers a software-as-a-service (SaaS) platform for real estate professionals, with features such as:
- Management of real estate listings
- CRM tools (customer relationship management)
- Communication with potential customers
- Analysis and reporting functions
- document management and secure filing
We reserve the right to change, update, or remove features at any time. We will inform you in good time about any significant changes.
It is necessary to create a user account to use the real estate software. You are responsible for keeping your login credentials secure and ensuring that all activity using your account is in accordance with these terms and conditions.
Pricing models
Nestermind works with a subscription model. There are different tariff levels with different features. All prices are in CHF and are payable in advance via our website or app. Unless otherwise stated, the subscription automatically renews at the end of each billing period (monthly or yearly) unless canceled beforehand.
Cancellation and refund
You can cancel your subscription anytime. Unless otherwise required by law, no refund will be made for periods that have already been paid but not used. If payment is not received, we reserve the right to suspend or terminate access upon prior notice.
Price adjustments
Nestermind is entitled to adjust the prices for its subscription models with effect for future billing periods. The changed prices are valid from the start of the next extension period. Customers will be informed in writing (e.g. by email) at least 60 days in advance. Without feedback from the customer within 30 days, the adjusted conditions are considered accepted.
You agree not to use the Service for the following purposes:
- Posting or uploading illegal, fraudulent, misleading, or offensive content
- Sending spam or unsolicited messages
- Data scraping or automated platform readout
- Interfering with or affecting the security or performance of the platform
We reserve the right to remove content or suspend accounts that violate these terms.
You can upload content to the platform, including listings, images, documents, and customer data.
You retain ownership of your content. However, by uploading, you grant Nestermind a worldwide, royalty-free right to display, store, and use the content as part of the service. Nestermind has the right to commercialize aggregated data in pseudonymous form.
You are responsible for ensuring that you have all necessary rights to use and share this content.
We collect and process personal data in accordance with our privacy policy and applicable data protection laws, in particular the Swiss Data Protection Act (DSG).
By using the service, you agree that Nestermind collects and processes personal information about you and your customers to the extent necessary to provide the service.
Our platform can integrate third-party services, such as payment processors, analytics tools, storage solutions, and property-specific offerings.
We assume no responsibility for the services of these third-party providers. Their use is subject to the respective terms and conditions of these providers.
In the event of violations of these terms and conditions, late payment, or misuse of the platform, we may suspend or cancel your access to the service at any time.
You can cancel your account yourself at any time via account settings or contact our support team.
Nestermind's liability is limited to intentional and gross negligence. To the extent permitted by law, Nestermind is not liable for indirect, incidental, or sequential damages arising from the use of the service.
We may update these terms and conditions from time to time. If there are significant changes, we will inform users by email or via the platform. If the terms and conditions are significantly amended, customers have the right to extraordinarily cancel the subscription within 30 days. Continued use of the service after the changes come into force is considered consent to the change.
These conditions are subject to Swiss law. The courts in Zurich, Switzerland, have exclusive jurisdiction over disputes in connection with these terms and conditions.
